Terms of Use

Terms of Use

1. Scope and Acceptance of Terms

By accessing this courses.kaupenjoe.net ("School"), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. Your use of the School is also governed by our Privacy Policy, which outlines how we collect and protect your data.

2. Merchant of Record and Billing

Payments, billing, tax collection (including VAT), and initial statutory refunds are processed securely by our platform host, Teachable, Inc., which acts as the Merchant of Record. By purchasing a course or membership, you enter into a financial transaction with Teachable and agree to Teachable’s Terms of Purchase. These Terms of Use govern your access to the intellectual property and community provided by the School.

3. Intellectual Property & Use License

The materials provided within this School fall into two distinct categories, governed by different licenses:

  • Course Content: All instructional content, including videos, text lessons, and curriculum design, is the exclusive property of the School. You are granted a limited, personal, non-exclusive, non-transferable license to access this content for your personal education. You may not download, redistribute, record, copy, or use these materials for any commercial or public purpose.
  • Downloadable Assets (MIT License): Specific downloadable assets (such as source code, images, pixel-art, or sprites) are provided under the MIT License unless stated otherwise. You may modify, distribute, copy, and use these specific materials for commercial or non-commercial purposes, provided you include the original copyright notice and permission notice. Always check the CREDITS and LICENSE file provided with each downloadable file.

4. Account Creation & Security

Your account is for your individual use only. You may not share your login credentials with any third party. Unauthorized sharing of account credentials is a violation of these Terms and will result in the immediate termination of your account without notice and without a refund.

5. Refund & Cancellation Policy

We offer a voluntary 30-day refund policy for the initial purchase of a course or the first month/year of a new membership subscription. If you are unsatisfied, you may request a refund within 30 days of your original purchase date.

  • Memberships: This 30-day refund window applies only to the initial sign-up charge. Subsequent recurring membership renewals are not eligible for refunds, but you may cancel your subscription at any time to prevent future charges.
  • Statutory Rights: This voluntary policy applies in addition to, and does not limit, any mandatory 14-day statutory right of withdrawal (Widerrufsrecht) that EU/EEA consumers may have under law, which is handled directly by Teachable during checkout.

6. Earnings and Results Disclaimer

The School provides educational resources designed to help you learn and improve your skills. However, the School does not guarantee any specific results, job placements, or financial earnings. Your success depends entirely on your own effort and implementation.

7. User-Generated Content & Community Conduct

If the School includes community forums or comment sections:

  • You agree not to post content that is unlawful, harassing, defamatory, abusive, threatening, or spam.
  • We reserve the right to review, edit, or delete any user-generated content and to ban users who violate these guidelines without a refund.
  • By posting public content (such as code snippets), you grant the School a non-exclusive right to display and reproduce that content within the context of the School's community.

8. Statutory Warranties for Digital Products

The School strives to provide high-quality and accurate materials. For consumers within the EU, statutory warranty rights for digital products (§§ 327 ff. BGB) apply. We will provide necessary updates to keep the digital product functional as reasonably expected. However, the School may make changes to the materials contained on its website at any time without notice.

9. Limitation of Liability

The School is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) on the part of the School or its legal representatives.

For slight negligence (leichte Fahrlässigkeit), the School is only liable if material contractual obligations (Kardinalpflichten) are breached—obligations whose fulfillment is essential for the proper execution of the contract and on which the user may regularly rely.

In such cases of slightly negligent breach of material obligations, liability is limited to the foreseeable, typically occurring damage. Any further liability for damages is excluded.

10. Links and Impressum

The School is not responsible for the contents of any external linked sites. Use of any such linked website is at your own risk. For our full legal disclosure as required by German law, please refer to the "Impressum" link located in the footer of our website.

11. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, mandatory consumer protection provisions of your home country remain unaffected by this choice of law.
